Compensation Limits (after 6 April 2022)


A week’s pay - £571

 

Failure to give a statement of particulars of employment - £1,142 or £2,284 (2 or 4 weeks’ pay)

 

Breach of the right to be accompanied at a grievance or a disciplinary meeting - £1,142 (2 weeks’ pay)

 

Breach of the flexible working provisions - £4,568 (8 weeks’ pay)

 

Failure to collectively consult  on redundancy - up to 90 day’s gross pay

 

Unfair dismissal:                      

  • Basic award - maximum £17,130
  • Compensatory award (or the lesser of 52 weeks’ pay) - maximum £93,878
  • Additional award (failure to reinstate or reengage) - £14,846 to £29,692 (26 to 52 weeks’ pay)

 

Dismissals for union/employee representative or pension trustee reasons:

  • Basic award - maximum £17,130 (minimum £6,959)
  • Compensatory award - maximum £93,878

 

Dismissals for health and safety reasons:

  • Basic award - maximum £17,130 (minimum £6,959)
  • Compensatory award - no limit

 

Dismissals for making a protected disclosure:

  • Basic award - maximum £17,130
  • Compensatory award - no limit

 

Blacklisting cases - maximum £17,130 (minimum £5,000)

 

Inducements relating to union activities - maximum £4,554

 

Unjustifiable discipline or expulsion by a union - maximum £111,008 (minimum £10,628)

 

Statutory redundancy payment - maximum £17,130

 

Contract claims - maximum £25,000

 

Failure to consult on a transfer - up to 13 weeks’ gross pay                                                                                        

Guarantee payment - £31 per day maximum 5 days or £155 in 3 months)


Compensation for injury to feelings (Vento bands):

  • Lower band - £990 to £9,900 (less serious cases)
  • Middle band - £9,900 to £29,600 (cases that do not merit an award in the upper band)
  • Upper band - £29,600 to £49,300 (the most serious cases)



Insolvency Payments (for dismissals after 6 April 2022)                          


Arrears of pay - up to £4,568 (maximum 8 weeks’ pay)

 

Statutory notice pay - up to £6,852 (maximum 12 weeks’ pay)

 

Holiday pay - up to £3,426 (maximum 6 weeks’ pay)

 

Statutory redundancy payment or basic award - up to £17,130 (maximum 30 weeks’ pay)     

 

Statutory Sick Pay (from 6 April 2022)

   

Standard rate - £99.35 (maximum 28 weeks)

 

Parental Payments (from 3 April 2022)

   

Statutory maternity pay (higher rate) - 90% of normal weekly earnings (maximum 6 weeks)                                                

 

Statutory maternity pay (basic rate) - £156.66 (maximum 33 weeks)

 

Maternity allowance - £156.66 (maximum 39 weeks)

National Living/Minimum Wage (from 1 April 2022)

 

Workers aged 23+ - £9.50 an hour

 

Workers aged 21-22 - £9.18 an hour

 

Workers aged 18-20 - £6.83 an hour

 

Workers under 18 - £4.81 an hour

 

Apprentices - £4.81 an hour

 

Accommodation offset limit (maximum daily deduction from NMW) - £8.70
